Regarding leases on rented accommodation:1. Is it usually the case that rental leases are either 18 months or 4 years? Is it possible to have a different term, say one year? What happens after the original lease is over - another set period of time? A month by month arrangement? 2. Is it usually the case that leases are registered with L'Agenzia delle Entrate? What does this mean for the tenant as regards being forced to take residency or have an anagraphic presence?3. Is it usually the case that the landlord asks for 3 months rent in advance?A British friend wishes to rent an apartment in a small town in Sardinia and these are his questions. He does not want to take out residency and does not understand the consequences of the registration of the lease with L'Agenzia delle Entrate. He also would prefer a more flexible letting arrangement regarding length of term but it seems this does not exist. Thanks.

Your friend should get a contratto transitorio which is for any length of time up to 18 months (but over 30 days) and which not forsee the tenant having residency at the address. It should be registered at the Agenzia dell'Entrate by law - for which the landlord and the tenant pay 50% usually. It can be renewed again for any period up to 18 months. HE will have to get a codice fiscale, but that is all.. 2 or 3 months rent in advance is normal - but is open to negotiation. He can try to pay 1 month in advance and 1 month as a returnable deposit - at the end of the contract.
