Here we had the same problem. We had to go to the Commune Technical Office. One of their guys came out to look, agreed it was dangerous and took photo's of it as well. We then received permission to cut it down, with a copy sent to the Forestalie. As it was an Oak, you are expected to plant 2 more trees to replace it.

I agree with Badger - oaks are among the trees you can't just cut down at will, you do need permission to do so and can be fined if you fail to obtain it even if there was a good reason ie dead/dangerous. You will be asked to plant another tree in its place, don't think it needs to be the same type. At least you will have a good supply of wood once it has seasoned!

I'm very pleased about the 2 trees to replace one rule - I was told that firewood from Albania was being imported to Abruzzo which is crazy! Abruzzo has lots of lovely trees and thanks to nice damp springs they seem to do very well. We have some nice big oaks and I've even bought acorns back to the UK and have 4 saplings.
